1. General Rental Agreement
By booking with OBX Beach CO., the renter agrees to be fully responsible for all rented items during the rental period,
including loss, theft, misuse, neglect, and damage beyond normal wear and tear.
2. Authorized Use
Rented items may only be used by the renter and approved users in a safe and lawful manner.
The renter agrees not to allow reckless, unsafe, intoxicated, illegal, or unauthorized use of any rental product.
3. Condition of Equipment
All equipment is provided in good working condition to the best of our knowledge. The renter must inspect the equipment
upon delivery or pickup and notify OBX Beach CO. immediately of any issue before use.
4. Assumption of Risk
The renter understands that use of golf carts, e-scooters, e-bikes, beach cruiser bikes, surfboards, paddleboards,
chairs, umbrellas, cabanas, wagons, coolers, tables, and chairs involves inherent risks, including injury, death,
collision, falls, weather exposure, water-related danger, and property damage.
The renter voluntarily assumes all risks related to the use, transport, storage, and operation of rented products.
5. Release of Liability
To the fullest extent permitted by law, the renter releases and holds harmless OBX Beach CO., its owners, employees,
contractors, and affiliates from any and all claims, demands, damages, losses, actions, causes of action, liabilities,
costs, and expenses arising from or related to the rental, possession, transport, delivery, setup, or use of any rented item.
6. Damage, Loss, and Theft
The renter is financially responsible for lost, stolen, missing, or damaged equipment, including repair costs,
replacement costs, cleaning costs, collection costs, downtime, and any related fees.
7. Rules for Ride Rentals
The following applies to ride rentals including:
- 4 Seater Golf Carts
- E-Scooters
- E-Bikes
- Beach Cruiser Bikes
The renter agrees to operate ride rentals safely, follow all local laws, use only designated areas where allowed,
and never operate while impaired. Minors may not operate ride rentals unless explicitly allowed by law and approved by a parent or guardian.
Helmets and safe driving practices are strongly recommended where applicable. The renter is solely responsible for tickets,
violations, towing, impound fees, injuries, and damages resulting from operation.
8. Rules for Water Rentals
The following applies to water rentals including:
Water conditions can be dangerous. The renter accepts all risks related to currents, waves, drowning, weather,
collision, and watercraft use. OBX Beach CO. is not responsible for injuries, accidents, rescues, or losses of any kind.
9. Rules for Beach Essentials
The following applies to beach essentials including:
- Beach Chairs
- Beach Umbrellas
- Beach Cabanas
- Beach Wagons
- Coolers
The renter is responsible for proper setup, safe placement, securing items against wind, and normal supervision of all equipment.
OBX Beach CO. is not liable for injuries or damage caused by improper use, weather, or unattended equipment.
10. Rules for Event Rentals
The following applies to event rentals including:
- Folding Tables
- Folding Chairs
The renter is responsible for setup area safety, weight limits, surface stability, weather protection, and preventing misuse.
OBX Beach CO. is not responsible for injuries, collapse, pinching, tipping, or damages caused by improper setup or use.
11. Delivery / Pickup
The renter agrees to provide accurate delivery and pickup information and to ensure the drop-off area is lawful and accessible.
OBX Beach CO. is not responsible for delays caused by incorrect information, weather, unsafe access, road issues, or events outside our control.
12. Identification and Verification
The renter agrees that OBX Beach CO. may require valid government-issued identification, a signature, contact details,
and other verification before releasing any equipment.
13. No Warranty
Except where required by law, all rentals are provided as-is and as-available, without warranties of any kind,
express or implied, including merchantability or fitness for a particular purpose.
14. Indemnification
The renter agrees to defend, indemnify, and hold harmless OBX Beach CO. from any claims, liabilities, damages, costs,
and attorney’s fees resulting from the renter’s use, misuse, possession, transportation, or return of any rental item.
15. Governing Law
This agreement shall be governed by the laws of the State of North Carolina. Any dispute shall be handled in the proper courts
of North Carolina unless applicable law requires otherwise.
16. Agreement
By checking the agreement box and signing, the renter confirms that they have read, understood, and agreed to these terms
and conditions and that their electronic signature is intended to have the same force and effect as a handwritten signature.
